Arabic Abstract

لقد شهد العالم في العقود الأخيرة من الزمن ثورة من المعلومات التكنولوجية، التي تولدعنها العديد من التطبيقات التي أثرت و بدرجة كبيرة على عدد من الميادين المختلفة بما فيها قطاع العدالة.

وذلك من خلال طرح فكرة النزاع القضائي الإلكتروني عن طريق خلق المحاكم الإلكترونية و إتباع كافة إجراءات التقاضي الإلكترونية و إثباتها بمختلف وسائل الإثبات الحديثة يعتبر الإثبات من أهم وسائل التقاضي، إلا أنه أصبح لا يقتصر فقط على وسائل الإثبات المعروفة تقليديا، بل تعداه إلى ظهور أدلة إثبات حديثة يعتد بها في المحاكمة الإلكترونية، أهمها التوقيع الإلكتروني.

و تماشيا مع التشريعات الدولية و التطورات التكنولوجية، عمل المشرع الجزائري على تكريس هذه الوسيلة بموجب القانون رقم 15/ 04 المتعلق بالتوقيع و التصديق الالكترونيين، باعتباره وسيلة ذات قوة ثبوتية في إثبات المستند القانوني الذي يعد المرجع لأطراف الدعوى.

English Abstract

In the last decades, the world has witnessed a revolution of technological information that has generated many applications that have greatly affected a number of different fields, including the justice sector, by introducing the idea of electronic judicial dispute, by creating electronic courts, And follow all electronic litigation procedures, and prove them by various modern means of proof.

Evidence is one of the most important means of litigation, but it has become not limited to the traditionally known means of proof, but also to the emergence of modern evidence that is reliable in electronic trial, the most important of which is electronic signature, and in line with international legislation and technological developments, the Algerian legislator has worked to dedicate This method is under Law No.

04/15 related to electronic signature and ratification, as it is a powerful means of proving the legal document that is the legal reference for the parties to the case.
