Arabic Abstract

إن التطـور التكنولـوجي و الثـورة الرقميـة التي يعيشها العالم أثرت على كافة مجالات الحياة بما فيها المنظومة القضائية، من خلال ظهور نظام قضائي جديد قائم على أسس و قواعد و تشريعات و احكام قضائية في ظل عصر المعلوماتية و التقنية الرقمية، إذ ظهر كنتيجة حتمية خاصة أمام بطئ العدالة التقليدية و عبئ تكاليفها المالية مما أثقل كاهل المتقاضين، و من هنا ظهرت الحاجة الملحة لحل هذه المشاكل و الحرص على إتباع آلية التقاضي عن بعد، نظرا لما يتميز به من سرعة الفصل في القضايا و تقليل الجهد والوقت و تحسين جودة العمل القضائي، و نظرا لأهمية الموضوع تبنت معظم التشريعات الدولية و الداخلية هذا النظام ضمن منظومتها القضائية، و في هذا السياق نجد أن المشرع الجزائري هو الآخر أعلن مساهمته في تطوير و عصرنه قطاع العدالة وواكب هذه التطورات و المستجدات من خلال قانون 03-15 المتعلق بعصرنة العدالة و تعديل قانون الاجراءات الجزائية بموجب الأمر 04-20.

و من ثمة نهدف من خلال هذه الدراسة الى معرفة ماهية نظام التقاضي الإلكتروني و إبراز مختلف التحديات و الصعوبات التي تعترض تطبيقه.

English Abstract

Technological development and the digital revolution that the world is experiencing have affected all areas of life, including the judicial system, through the emergence of a new judicial system based on foundations, rules, legislation and judicial rulings in the light of the age of information and digital technology.

The financial situation has burdened the litigants, hence the urgent need to solve these problems and ensure that the litigation mechanism is followed remotely, due to its speed of adjudication of cases, reducing effort and time and improving the quality of judicial work, and given the importance of the subject, most international and internal legislation adopted this system within its judicial system, and in this context, we find that the Algerian legislator also announced his contribution to the development and modernization of the justice sector and kept pace with these developments and developments through Law 03-15 related to the modernization of justice and the amendment of the Code of Criminal Procedure pursuant to Order 04-20.

Hence, we aim through this study to know the nature of the electronic litigation system and to highlight the various challenges and difficulties in its application.
