يعد التقاضي الإلكتروني نتاجا للتطور التكنولوجي و المعلوماتي، حيث أصبح الحديث عن تقديم الخدمات و المعلومات في صورة رقمية، بعيدا عن الشكل التقليدي أي الورقي، فالتقاضي الإلكتروني يقوم على إستخدام وسائل الإتصال الحديثة و يعتمد على برامج و وسائط إلكترونية لتبادل المعلومات و البيانات المتعلقة بالخصومة.
لكن قد تعترض سيرورة المحاكمة الإلكترونية عراقيل تقنية، أهم صورها القرصنة الرقمية، إذ يتم إختراق الوسائل التقنية المعتمدة في التقاضي الإلكتروني مثل: البريد الإلكتروني، و ذلك بهدف تزوير البيانات أو التشهير بسمعة أحد الخصوم و كشف أسرار الدعوى، لذلك كان من الضروري تكثيف الحماية التقنية للأنظمة المعتمدة في التقاضي الإلكتروني.

Electronic litigation is based on the use of modern means of communication and depends on programs and electronic media to exchange information and data related to litigation.
However, the electronic trial process may encounter technical obstacles, the most important of which is digital piracy, as the technical means adopted in electronic litigation, such as: e-mail, are breached, with the aim of falsifying data or defaming the reputation of one of the opponents and revealing the secrets of the case, so it was necessary to intensify technical protection For the systems adopted in electronic litigation.
