Arabic Abstract

كان للتطور التكنولوجي و الثورة الرقمية أثرا مباشرا على المجال القضائي الذي واكب هذا التطور بتطبيق ما يعرف بالتقاضي الإلكتروني، و استطاعت الوسائل التكنولوجية الحديثة تحويل المحاكم التقليدية إلى محاكم إلكترونية؛ عن طريق إدخال وسائل رقمية متقدمة، كنشر المعلومات و القرارات القضائية للجميع و الاطلاع على الوثائق و المستندات عبر الإنترنت من خلال بوابات إلكترونية، و تهدف هذه الورقة البحثية إلى دراسة أحكام التقاضى الإلكتروني من خلال تفصيل مفهومه و مزاياه، و سلبياته، و إجراءاته، بالإضافة إلى متطلباته.

English Abstract

Technological development and the digital revolution have had a direct impact on the judicial field, which has accompanied this development by applying what is known as electronic litigation, and modern technological means have been able to turn traditional courts into electronic courts, by introducing advanced digital means, such as the dissemination of information and judicial decisions for all and access to documents and documents online through electronic portals, and this research paper aims to study the provisions of electronic litigation by detailing its concept and advantages, and its disadvantages, and its procedures, in addition to its requirements.
