Abstract EN

The policy of criminalization and punishment is one of the most important policies on which the penal system is based within each country, as the international legislator, including the national legislator, pays special attention to it, given its impact on security within society.

Perhaps the countries' adoption of the so-called electronic litigation system has had a significant impact on this policy, and in particular on those basic principles of a fair trial for the accused.

The national legislator followed the example of the rest of the legislators in adopting this system since its enactment of Law 15-03 related to the modernization of justice and the amendments that occurred to the Code of Criminal Procedure, which has contributed significantly to influencing the policy of criminalization and punishment in Algeria.
