Abstract EN

Ijtihad in Islamic jurisprudence constitutes an important base in the jurisprudential construction of rulings.

The Islamic Sharia allowed the mujtahid to research and consider the rulings in order to implement the purposes of God Almighty in what he wanted, and since the interests of the people are considered, the system of Islamic rulings has made controls and rules that the mujtahid must observe while dealing with these issues, and we are looking in this study on the important foundations that do not The mujtahid can and cannot ignore or override them while researching the legal rulings related to society.

Accordingly, we dealt in our study with what is related to the jurisprudence of societies without specifying, as they are broad lines that are applied in all parts of the earth.

In order to reach the goal we want, we made the following work plan: First: A definition of search terms, Second: The role of Sharia in social assessments, Third: The necessary foundations for considering Shariah rulings.

Finally, we concluded that it is the duty of the mujtahid to observe the jurisprudence of reality; Know the conditions of people and society; realizing the aims of the street with knowledge of the limits of jurisprudence issues; Without neglecting priorities or not balancing interests.
