Abstract EN

The issue of circumvention of law within the scope of private international law has not received sufficient attention from law makers and commentators.

although the Jordanian legislature has established the legal norms governing the issue of conflict involving a foreign element, the topic of circumvention of the law has not been regulated by clear and explicit provisions in Jordanian legislation governing the subject of private international law.

the lack of ambiguity and inadequacy are the main features of such legislation and given the gravity of circumventing the law in conflicts involving a foreign element on the rights of individuals, especially the state.

this study shows and analyses the adequacy and legal impact of laws that regulate circumvention of the law.
