I aim through this study to highlight the nature of the SC’s mandate for military intervention in Libya, in terms of referring humanitarian situation that prevailed there at the time to the ICC, on the grounds that it constitutes a threat to international peace and security (analytical approach).

what makes this hypothesis is that it came in the context of the events of the Arab spring (historical approach).

and an administration that is any transitional phase during it, it is assumes in any strategy, whatever its nature and purpose, requires a commitment not to delegate even part of its national sovereignty to NATO in particular.
