Abstract EN

This study aims to clarify the new legal provisions governing start-up companies, which came in the context of addressing the challenges facing entrepreneurs, especially the legal form of their institutions, which has become defined within the framework of a new type of companies called the simple joint stock company.

The study concluded several results, the most prominent of which is the crystallization of the legal form of the institutions that obtained the “start-up” mark, as they have become adapted to being a simple joint stock company, and that their establishment, management and management are subject to the provisions related to the joint stock company unless they conflict with the special provisions governing it contained in Articles 715 bis.

133 to 715 bis 143 of Law 22-09 amending and supplementing the Algerian Commercial Code.
