Monopolistic practices harmful to free competition are numerous and their forms vary, as they are no longer limited to collusive agreements between some competitors in order to impede the movement of supply and demand and influence prices, but are now taking the character of a single and comprehensive monopoly in the market through the establishment of major institutions By expanding and acquiring the rest of the competitors, in what is termed in the competition protection systems of economic concentrations; However, due to some positive aspects of the phenomenon of economic concentrations for the national economy, they are not punished with the same severity as the rest of the anti-competitive practices, as they are treated in a very special way known in competition protection systems as the prior control of concentrations, which is what this article attempts to highlight in the context of Ordinance 03-03 relating to competition.
