تكمن خصوصية المركز القانوني للمؤسسة العمومية ذات الصبغة الصناعية و التجارية في طبيعتها القانونية المتميزة بالنظر إلى اعتبارها في آن واحد بمثابة شخص من أشخاص القانون العام و تاجرة في علاقاتها مع الغير مما يرتب آثار على نظامها القانوني الذي يتسم بالازدواجية بالنظر إلى خضوعها لأحكام القانون الخاص نتيجة ممارستها لنشاط صناعي و تجاري مع تقييدها بنظام غير مألوف في نطاق القانون الخاص يقتضيه الطابع المرفقي للنشاط الذي تمارسه قصد تحقيق المصلحة العامة.
Abstract EN
The peculiarity of the legal status of the public industrial and commercial establishment lies in the specificity of its legal nature in that it is regarded as a legal person under public law and simultaneously perceived as a trader in its relations with third parties, what impacts the ambivalent legal regime applicable to it in so far as, if it is subject to private law by reason of the exercise of an industrial and commercial activity, it also applies to an exorbitant system of ordinary law imposed by the exercise of a public service activity for the purpose of the general interest.

La particularité du statut juridique de l’établissement public à caractère industriel et commercial réside dans la spécificité de sa nature juridique en ce sens où il est considéré comme une personne morale de droit public et simultanément perçu comme un commerçant dans ses relations avec les tiers, ce qui impacte le régime juridique ambivalent qui lui est applicable dans la mesure où, s’il est soumis au droit privé en raison de l’exercice d’une activité industrielle et commerciale, il l’est également à un régime exorbitant de droit commun qu’impose l’exercice d’une activité de service public dans un but d’intérêt général.
