حتى يتسنى البحث في جريمة رشوة الموظفين العموميين ؛ وجب ابتداء تحديد المقصود بالموظف العمومي، إذ يعتبر هذا الأخير إضافة إلى صفته السالفة الذكر ركنا من أركان جريمة الرشوة، و على اختلاف المفاهيم المحددة لهذه الصفة و هذا الركن باختلاف القوانين و مجالات البحث، يبقى قانون الوقاية من الفساد و مكافحته القانون المتصدي بمفهوم أكثر اتساعا لصفة الموظف العمومي مرتكب جريمة الرشوة ؛ و هو ما نحاول تبيانه من خلال هذه الدراسة.
Abstract EN
In order to investigate the crime of bribing public officials, the intention of the public official must begin to be determined, as the latter, in addition to its abovementioned status, is considered to be a pillar of the crime of bribery, and in different concepts specific to this characteristic and this pillar by different laws and areas of research, the law on the prevention and control of corruption remains the law addressed in a broader sense of the character of the public official who committed the crime of bribery, which we are trying to show through this study.

Afin d'enquêter sur l'infraction de corruption d'agents publics ; il convient d’abord de définir ce que l'on entend par agent public, car ce dernier, en plus de sa qualité précédemment citée, est considéré comme l'un des éléments de l’infraction de corruption, et malgré les différentes définitions données à cette qualité et cet élément dans différents textes de loi et domaines de recherches, la loi relative à la prévention et à la lutte contre la corruption reste celle qui offre la définition la plus large de la qualité de l'agent public en tant qu'auteur d’infraction de corruption ; c'est ce que nous essayerons de démontrer à travers cette étude.
