Abstract EN

This research aims to highlight the relationship between copyright and legal deposit, whether it is linked to its original protection, or preferably, does the creation or the filing, and whether its protection depends on the completion of this procedure.

I concluded, through this research, that original creativity constitutes a foundation of copyright and that its stature appears from the creation of the literary or artistic work without the need to deposit it with the competent body, in this case the national library or the Algerian movie center.

in addition, the legal deposit is a legal obligation imposed on any natural or legal person holding an intellectual production, but has no effect on copyright.

it is rather a formal administrative procedure, which has only a conservation character, since is only a simple presumption of ownership of the work of the person who deposited it in the first time, the filing then being only a reinforced protection measure, and not a creation of the intellectual property right.

Abstract FRE

La présente recherche vise à faire la lumière sur la relation du droit d’auteur avec le dépôt légal, que cette relation soit liée à sa naissance ou à sa protection, ou préférablement, est-ce que le fondement du droit d’auteur réside dans la création ou le dépôt, et si sa protection dépend de l’accomplissement de cette procédure.

j’en ai conclu, à travers cette recherche, que la créativité originale constitue une assise pour le droit d’auteur et que sa stature apparait dès la création de l’oeuvre littéraire ou artistique sans qu’il soit nécessaire de faire le dépôt auprès de l’organisme compétent, en l’occurrence la bibliothèque nationale ou le centre cinématographique Algérien.

aussi, le dépôt légal est une obligation légale qui s’impose à toute personne physique ou morale détentrice d’une production intellectuelle, mais qui n’a qu’un caractère de conservation, puisqu’il ne s’agit que d’une simple présomption de propriété de l’oeuvre de celui qui l’a déposé en premier, le dépôt n’étant alors qu’une mesure de protection renforcée, et non une création du droit de propriété intellectuelle.
