تعد جريمة بيع الأطفال من الجرائم الخطيرة المستحدثة لما لها من آثار سلبية تنعكس على المجتمع الدولي بصفة عامة و على المستوى الوطني بصفة خاصة، حيث أن التطور التكنولوجي ساهم في تطوير هذه الجريمة و أدخلها في نطاق الجرائم المنظمة فأصبحت مختلفة عن الجريمة العادية و ذات خصوصية تنفرد بها وحدها، مما كثف الجهود الدولية للقضاء عليها بإبرام البروتوكول الاختياري بشأن بيع الأطفال و استغلالهم في البغاء و المواد الإباحية، و صادقت عليه الجزائر سنة 2006 و تم إخاله في المنظومة القانونية سنة 2014 ضمن المادة 319 مكرر من قانون العقوبات المعدل و المتمم بالقانون رقم 01-14 المؤرخ في 4 فبراير 2014.

The crime of selling children is one of the new serious crimes because of its negative effects that are reflected on the international community in general and on the national level in particular, as the technological development has contributed to the development of this crime and introduced it to the scope of organized crimes, which has become different from the ordinary crime and with a specificity that is unique to it alone, which intensified international efforts to eliminate it by concluding the optional protocol on the sale of children, child prostitution and child pornography, ratified by Algeria in 2006 and introduced into the legal system in 2014 under article 319 BIS of the penal code amended and supplemented by law n° 14-01 of February 4, 2014.

Le crime de vente d'enfants est l'un des nouveaux crimes graves en raison de ses effets négatifs qui se répercutent sur la communauté internationale en général et au niveau national en particulier, car le développement technologique a contribué au développement de ce crime et l'a inclus dans la portée de la criminalité organisée, devenue différente de la criminalité ordinaire et avec une spécificité qui lui est propre, chose qui a intensifié les efforts internationaux pour l'éliminer en concluant le protocole facultatif sur la vente d'enfants, la prostitution des enfants et la pornographie mettant en scène des enfants, ratifié par l'Algérie en 2006 et introduite dans le système judiciaire en 2014 en vertu de l'article 319 BIS du code pénal modifié et complété par la loi n° 14-01 du 4 Février 2014.
