Abstract EN

First of all, the crimes combating of assaulting the intangible property of the commercial company has become the concern of the Algerian legislator, as it is imperative to ensure the preservation of it and the national economy, and among the legal mechanisms that have been devoted is the possibility of taking precautionary measures to protect it, which are taken in the event of an assault on intangible property or if this an imminent assault, through which it aims to prevent, stop or prove its occurrence and preserve the evidence.

finally, the aim of the study of precautionary measures is to highlight their importance in protecting the intangible property of the commercial company and not being satisfied with the objective protection.

therefore, the precautionary measures are of great importance in protecting intangible property, making them enjoy an independent legal system that has its own concept, different from other judicial mechanisms for the protection of intangible property.

La lutte contre les crimes commis sur le bien moral d’une société commerciale représente une priorité pour le législateur Algérien et une nécessité pour sauvegarder ce bien et celui de l'économie nationale.

parmi les mécanismes juridiques pris par le législateur la possibilité d’entreprendre des procédures conservatoires afin de sauvegarder ce bien moral en cas d’atteinte.

les mesures précédentes visent à parier à toute atteinte, prévenir toute menace et à préserver les preuves.

cette étude a pour but de démontrer que ces procédures conservatoires ont un rôle aussi important que la protection objective du bien moral d’une société commerciale.

c’est la raison pour laquelle le législateur algérien leur a prévues un régime juridique propre et autonome.
