يعتبر مجلس المنافسة سلطة إدارية مستقلة مكلفة بضبط السوق و حماية المنافسة الحرة و النزيهة، و لتأدية مهامه منح المجلس سلطات عديدة أهمها سلطة القمع التي من خلالها يتم توقيع عقوبات إدارية على كل مؤسسة ارتكبت أحد الممارسات المحظورة.
لما منح مجلس المنافسة سلطة القمع، كان من الضروري منح المؤسسة المتابعة ضمانات لأجل توازن أطراف الخصومة و لضمان عدالة الحاكمة، و ذلك خلال كل مراحل الدعوى، و حتى بعد صدور القرار النهائي للمجلس.

The competition council has been legally qualified as an independent administrative authority responsible for monitoring the market in order to ensure economic efficiency.
the competition council has been given the power to repress practices prohibited by competition law.
granting repressive power to an administrative body had to be accompanied by guarantees for the balance of the parties to the dispute, during all the stages of the prosecution, and even after the decision of the council.

Le conseil de concurrence est une autorité administrative indépendante, chargée de la régulation du marché et de la protection de la libre concurrence.
afin de garantir l’efficacité du conseil, il a fallu lui attribuer plusieurs pouvoirs, dont celui de sanctionner administrativement l’entreprise poursuivie pour entrave à la concurrence.
face à ce pouvoir exceptionnel, il a fallu octroyer à l’accusé à en contrepartie, toutes les garanties d’un procès equitable.
