تعتبر مسألة تحديد القانون الواجب التطبيق على العقد التجاري الدولي حال غياب قانون الإرادة من أكثر المسائل إثارة للنقاش في القانون الدولي الخاص، مما أدى إلى بروز حلول و مناهج مختلفة في إطار التشريعات الوطنية و الدولية، من هذه المناهج منهج أو فكرة الأداء المميز كمعيار لتحديد قانون العقد التجاري الدولي، القائم على تقديم تصور و رؤية جديدة للقانون الواجب التطبيق من خلال تفريد المعاملات العقدية الدولية، و تحديد قانون العقد الدولي على حسب قيمة و أهمية الأداء و وزنه، أي بالنظر إلى الطبيعة الذاتية للعقد.
يفترض منهج الأداء المميز أن القانون الأكثر ارتباطا بالعقد من خلال الطبيعة الذاتية له هو قانون مكان الإقامة المعتادة للمدين بالأداء المميز وقت إبرام العقد، و هو الافتراض الذي من شأنه أن يراعي مبدأ الأمان القانوني لمعاملات الأشخاص، و تقديم حلول مرنة تراعي تنوع و اختلاف العقود الدولية، و احترام توقعات الأطراف المشروعة على هذا تبنته العديد من التشريعات المقارنة.
Abstract EN
The issue of determining the law applicable to the international commercial contraction, the state of absence of the law of will it's one of the most controversial issues in private international law, which has to the emergence of different solutions and approaches within the framework of national and international legislation, one of these approaches is the approached or idea of exceptional performance as a criterion for decadent the law of international contraction.
this is a hypotheses that would take into account the principle of legal certainty in the transaction of personnel, and would the distinguished performance approach assumes that law most closely related to the contract by its subjective nature is the law of the place of habitual residence of the debtor of distingue performance.
provide flexible solutions taking into account international contracts, and respecting the exportations of legitimation parties in the arena adopted by many comparative laws.

La question de la détermination de la loi applicable au contrat de commerce international-en d'absence de la loi de la volonté-est l'une des questions les plus controversées en droit international privé, ce qui a mené à l'émergence d'approches différentes dans le cadre des conventions internationales et législations nationales, parmi elles l'idée de performance exceptionnelle comme critère déterminant la loi applicable.
l'approche de l'exécution distinguée suppose que la loi la plus liée au contrat par sa nature subjective est la loi du lieu de résidence habituelle du débiteur de l’exécution distinguée au moment de la conclusion du contrat.
cette hypothèse prendrait en compte le principe de la sécurité juridique des transactions des personnes, et apporterait des solutions souples tenant compte de la diversité et des différences entre les contrats internationaux, et respecterait les attentes légitimes des parties, c’est pour cela que plusieurs législations on fait le choix d’adopter ce critère dans la détermination de la loi applicable.
