إن الحماية الاجتماعية في سن الشيخوخة حق من حقوق الإنسان تدعمه معايير العمل الدولية، حيث يعتبر التقاعد أحد أهم المخاطر الاجتماعية المضمونة التي كفلتها التشريعات.
و تهدف هذه الورقة البحثية لدراسة الإطار العام لنظام التقاعد في الجزائر و الأزمة المالية التي يعاني منها الصندوق في ظل تفاقم نفقاته و قله مورداته، و طريقة تدخل المشرع الجزائري لإصلاح منظومة التقاعد على نحو يكفل ديمومة صندوق التقاعد و ينقذه من خطر الإفلاس.
Abstract EN
Social protection in old age is a human right supported by international labor standards, where retirement is considered one of the most important social risks guaranteed by legislation.
this research paper aims to study the general framework of the retirement system in Algeria and the financial crisis that the fund suffers from in light of the aggravation of its expenses and the lack of its resources, and the way the Algerian legislator intervenes to reform the retirement system in a way that ensures the sustainability of the retirement fund and saves it from the risk of bankruptcy.

La protection sociale des personnes âgées est un droit de l'homme soutenu par les normes internationales du travail, où la retraite est l’un des plus importants risques sociaux garantis par la législation.
ce document vise à examiner le cadre général du système algérien de retraite et la crise financière qui afflige le fonds alors que ses dépenses et ses ressources s’aggravent, et comment la législation algérienne intervient pour réformer le système de retraite afin d’assurer la viabilité du fonds de pension et de le sauver du risque de faillite.
