Are of the importance of documentation in ensuring the stability of transactions, the legislator intervened through a set of special laws that carried with them a clear legislative view in the quest to generalize the formality of transactions, believing that it is the way to ensure legal protection of legal acts to achieve contractual security in the search for legal means to ensure the fortification of contractual transactions, in order to secure the pillars of the legal peace, by providing preventive justice that spreads contractual security between the contracting parties, we found that the legislator granted the notary the power to write contracts with his obligation to ensure legal protection for these transactions by formalizing the agreements of the parties in a formality reinforced by many legal guarantees, challenging his testimony only by forgery.

Conscient de l’importance de la documentation pour assurer la stabilité des transactions, le législateur est intervenu par le biais d’un ensemble de Lois spéciales qui portaient en lui une vision législative claire dans la quête de généralisation de la formalité des transactions, estimant que c’est le moyen d’assurer la protection juridique des actes juridiques pour obtenir la sécurité contractuelle.

Dans la recherche de moyens juridiques pour assurer la fortification des transactions contractuelles, afin de sécuriser les piliers de la paix juridique, en assurant une justice préventive qui répand la sécurité contractuelle entre les parties contractantes, nous avons constaté que le législateur accordait au notaire le pouvoir de rédiger des contrats avec son obligation d’assurer la protection juridique de ces transactions en formalisant les accords des parties dans une formalité renforcée par de nombreuses garanties juridiques, ne contestant son témoignage que par la falsification.
