Abstract EN

The issue of the contribution of the foreign investment in financing the small and medium scale projects is considered from its legal perspective one of the most prominent issues that need to be tackled and processed without any bias and also to be given the utmost attention, and this is due to the importance of the subject as a substantial source of financing the investment projects.

However, those who says the opposite; from a standpoint to preserve the local economy against the dependency and also to keep the hard currency which is generated from oil; given that the foreign investor will work to transfer it abroad.

On the other hand, relying on it and considering it as a mechanism to finance projects is one of the results of the opening up to the outside and bringing technology and modern equipments.

In addition to that, it is considered one of the requirements of the market economy that Algeria accepted its principles in light of the acute financial crisis, especially due to its revenues from fuels decline; therefore, the results and the objectives envisaged from this research lies in that the foreign investment remains an effective way to generate hard currency and contribute to financing projects of various sizes, given that the legislator canceled the partnership rule 49/51% related to the productive investment of goods and services in non-strategic sectors under the supplementary financial law of 2020.
