is one of the effects of the marriage dissolution, it's an important issue for child protection, this subject raises many problems in the field of conflict of laws in Arab and Algerian legislation due to the difference in legislation on the applicable law.

Therefore, countries have sought to establish rules to solve the problem of conflict of laws in custody, but that does not mean solving all the issues raised by custody in the conflict of laws.

In order to respond to these problems, jurisprudence, legislation and the judiciary have sought solutions in accordance with the principle of protection of the interests of the child subject to custody.
