تهدف هذه الدراسة إلى التطرق إلى قطاع التأمين في الجزائر و التعرف على دور الجهات المكلفة بالإشراف و الرقابة عليه، و كذا التعرض إلى واقع التأمين التكافلي في الجزائر و أفاقه المستقبلية، و محاولة إظهار الأليات التي تسمح لهيئات الإشراف و الرقابة بتكييف نشاطها مع التأمين التكافلي في الجزائر.
و تم التوصل إلى أن القانون الجديد الذي يحدد شروط و كيفيات ممارسة التأمين التكافلي تطرق إلى الجانب الشكلي و الجوانب الإدارية للتأمين التكافلي دون الخوض في الأمور الفنية و التقنية المتعلقة بعملية الإشراف و الرقابة، لذلك وجب استكمال و تعزيز المنظومة القانونية للتأمين التكافلي بوضع إطار قانوني و تنظيمي خاص بعملية الإشراف و الرقابة على نشاط التأمين التكافلي في الجزائر.
Abstract EN
This study aims to address the insurance sector in Algeria and identify the role of the authorities in charge of supervising and controlling it, as well as exposure to the reality of Takaful insurance in Algeria and its future prospects, and trying to show the mechanisms that allow supervisory organizations to adapt their activities with Takaful insurance in Algeria.
it was concluded that the new law that defines the conditions and modalities for practicing Takaful insurance touched on the formal and administrative aspects of Takaful insurance without touching the technical things related to the supervision process Takaful in Algeria.
