قامت الجزائر باعتبارها جزءا لا يتجزأ من المنظومة الدولية لحقوق الأنسان، لاسيما تلك المتعلقة بحماية الطفولة، هذه الأخيرة عانت ومازالت تعاني من انتهاكات شتى لحقوقها باعتبارها بين الفئات الضعيفة.
إن أول خطوة قامت بها الجزائر في هذا المجال هي الانضمام للاتفاقية الدولية لحقوق الطفل لعام 1989، لكنها أصدرت بيانات تفسيرية بشأن بعض البنود التي تتعارض مع المبادئ الأساسية التي يقوم عليها المجتمع الجزائري.
حاول المشرع الجزائري جاهدا إيجاد نوع من الموائمة بين تشريعاتها الداخلية المتعلقة بحقوق الطفل والالتزامات الملقاة على عاتقها بموجب الاتفاقية الدولية لحقوق الطفل، وذلك من خلال إجراء تعديلات وإصلاحات تشريعية وقضائية.
Abstract EN
Algeria, is an integral part of the international human rights system, related to the protection of child, the child has suffered and continues to suffer from various violations of its rights, among the vulnerable groups.
the first step that Algeria took in relation to this problem by ratifying the international convention on the rights of the child of 1989, but it issued explanatory statements provisions with some interpretative declarations.
the Algerian legislator has tried to find a kind of harmonization between its internal legislation relating to the rights of the child and its obligations under the international convention on the rights of the child, by making legislative and judicial amendments and reforms.

l'Algérie, en tant que partie intégrante du système international des droits de l'homme, en particulier ceux liés à la protection des enfants, qui subit diverses violations de ses droits, car elle fait partie des groupes vulnérables.
la première étape que l'Algérie a franchie dans ce domaine est l’adhésion à la convention internationale des droits de l'enfant de 1989, mais elle a publié des déclarations explicatives sur certaines dispositions qui contredisent les principes fondamentaux sur lesquels repose la société algérienne.
le législateur algérien s'est efforcé de trouver une sorte d'harmonisation entre sa législation interne relative aux droits de l'enfant et ses obligations au titre de la convention internationale des droits de l'enfant, en procédant à des modifications et des réformes législatives et judiciaires.
