The Algerian legislator has created a new mechanism for the exploitation of wakfs real estate, which is the operating contract, this contract by virtue of which the administration of the endowment concedes the endowment real estate to an investor, natural or legal person, public or private, in order to operate and develop it according to specifications that define the rights and obligations of both parties, and the wakfs property is granted to the investor by public auction within the framework of the principles of competition and valuation of the exploited asset, but in exceptional cases it is possible to grant ownership by mutual consent.
