تعتبر آلية العدول عن التعاقد القائم في البيئة الرقمية من الضمانات القانونية التي وجدت خصيصا لتقرير الحماية القانونية للمستهلك الالكتروني نظرا لمركزه القانوني غير المتكافئ مع المورد الالكتروني ذو كفاءات و معرفة عالية بخبايا هذا النوع من العقود الرقمية، و كذا خصوصية العلاقة الاستهلاكية –بيع و شراء- القائمة في ظل عالم افتراضي ممزوج بتقنيات رقمية، لذا لقيت هذه التطلعات ردا عليها من قبل المشرع الجزائري من خلال الخطوة التشريعية المتمثلة في إصدار قانون رقم 18-05 المتعلق بالتجارة الالكترونية أين تطرق إلى تأطير آلية العدول بقواعد و أحكام تبين كيفية إعمالها في مجال التعاقد الالكتروني و المتمثلة على وجه الخصوص في تمكين المستهلك من التراجع عن التعاقد في مواضع قانونية معينة، و هذا كله نزولا عند نية المشرع في تحقيق توازن بين المصالح الشخصية للمتعاقدين إلكترونيا دون إفراط أو تفريط إلى درجة إهدار و تضييع هذه المصالح
Abstract EN
The mechanism of withdrawal from the contract in the digital environment is considered one of the legal guarantees that have been specifically found to protect the e-consumer due to its unequal legal position with the e-provider in terms of skills and knowledge of the complexities of this type of electronic contracts, as well as the confidentiality of the consumer relationship existing in the virtual world.
These aspirations have therefore been fulfilled by the Algerian legislator through law no 18/05 on E- commerce which allowed the consumer to revoke the contract in certain legal situations.
The legislator intended to create a balance between the personal interests of the contracting parties by electronic means without excess or negligence to the point of wasting and squandering these interests.
