Criminal evidence aims at inflicting the punishment on the offender by using available legal means, which require keeping pace with criminal methods development and ensuring the non- violation of one's personal freedoms and physical integrity, and the prohibition of self-incrimination.

Criminal justice agencies strive to extract evidence by adopting modern scientific methods such as hypnosis, genetic imprinting electronic and surveillance techniques, for example, intercepting correspondence and recordings.

This article aims to determine the legality of using these means.

The analytical approach was adopted to control texts considering scientific means, and recognizing the evidentiary value of the scientific derived evidence.

The study concluded that it is essential to achieve balance between requirements of the public interest and combating crime.

More, ensuring using scientific methods in accordance with procedural and substantive conditions and in the right way that the presumption of innocence, guarantees of the accused and his privacy are not violated.
