تهدف هذه الدراسة إلى إلقاء الضوء على صور الامتناع عن تنفيذ الأحكام القضائية و مبررات امتناعها، و كما هو معروف أن القضاء الاتحادي الإماراتي يأخذ في مجال الرقابة القضائية على مشروعية عمل الإدارة، بنظام القضاء الموحد.
فالمحاكم الإتحادية العادية هي التي تختص بالفصل في المنازعات الإدارية و غيرها من المنازعات على السواء.
و إن إحدى أهم وظائف الإدارية هي المحافظة على النظام العام بكافة عناصره، الأمن العام، الصحة العامة، السكينة العامة، الآداب العامة، و تشكل هذه الوظيفة في كثير من الأحيان ذريعة للإدارة تتصل من خلالها بالتزامها بتنفيذ الأحكام القضائية، فإذا كان يترتب على تنفيذ الحكم القضائي مساس بالنظام العام كما في حالة الضرورة مثلا، فيجوز للإدارة حينها ألا تنفذ الحكم محافظة على النظام العام، مما يمثل استثناء على الأصل العام و القاضي يلزم الإدارة بتنفيذ الأحكام القضائية.

This study aims to forms of refraining from implementing the judicical decisions and the the justiications of it's refraining, As is Well Known, the UAE federation judiciary takes the field of judicial oversight over the legality of the administration's work in the unifled gudicial system, the ordinary federal courts are competent to adjudicate administrative and other disputes a like.
And one of the most important administrative functions is to maintain public order with all its elements, security, public security, public health, public serenity, public decency, and this job often constitutes a pretext for the administration through which it relates to its opligation to implement judicial rulings, the administration is required to implement court rulings.
