The research studies the stability of the presumption of innocence, through a general follow-up of the legislative rules and judicial principles that relieve the restrictions imposed by this principle on the law enforcement authorities for the sake of combating crime and prosecuting criminals.

The research concludes that there are current legislative and judicial trends that seek to disrupt this presumption for the sake of combating crime, and the research recommends that this be accompanied by extensive studies of the reality of the criminal justice system according to the state’s political, economic, social and cultural characteristics, so that the disruption of the presumption of innocence does not lead to the state’s control over Individuals or the suppression of rights and freedoms under the pretext of confronting crime.
