يشهد العالم المعاصر ثورة كبيرة في مجال الإبداع والابتكار في شتى المجالات العملية الصناعية والتجارية مبنية على التخصص والدراية من قبل المهنيين والمحترفين في مجال تخصصاتهم، وفي المقابل توجد شريحة واسعة في المجتمع (المستهلكين) تتعامل مع هؤلاء المحترفين في شكل عقود أو تلقي خدمات، مما يستوجب البحث في النظام القانوني للمتعاقد المحترف.
