Abstract EN

This study shed light on resignation which is regarded as one of the most important themes in the public service law.

the Algerian legislator sought to guarantee this right for the public servant in the ordonnance n° 03-06 which comprised the fundamental law.

resignation is considered as one of the major causes of ending service thus losing the employment status.

so it was necessary to maintain this right with legislations that could in one hand enable the employee to abandon the job permanently and guarantee the functionality of the public facility on the other hand.
