Abstract EN

The research aims to study damage as a pillar of civil liability in Omani legislation because of its great importance, addressing its various aspects by following the descriptive and analytical approach for the purposes of addressing the problem which is the seriousness of the damage to which a person is exposed materially and morally, which revolves round a major question: what is the effectiveness of legal texts in addressing the subject of damage and how to estimate it? indicating the analysis how to address the legal defects and gaps in it, exposed to the forms of damage, its types and conditions to achieve it.

the research has concluded several results, including that the Omani legislation or divided the damage in to physical harm and financial damage, unlike the divisions followed and represented in material damage and moral damage, as the research concluded in the light of the results to several recommendations, the most important of which are: a proposal that damage be divided in Omani legislation into material damage and moral damage instead of dividing in to physical and financial.
