Recourse to the justice is the last resort for the public official who was referred for discipline, to exhaust the last guarantee granted to him in the face of the decision to impose the disciplinary penalty, and thus the judicial appeal is made by way of an action for annulment, which enables the administrative judge to censor the basis of the disciplinary decision, to extract the defects and thereby to annul the disciplinary decision and to remove its effect.

the administrative judge's supervision becomes the ultimate guarantee to reduce the arbitrariness of disciplinary authorities in issuing disciplinary decisions.
