Abstract EN

The public prosecution authority is one of the bodies that has been assigned the responsibility of activating the requirements of family provisions, as it has been granted powers and competencies to play its role entrusted with the proper application of the law, which is a positive role to establish the protection of public order and achieve the interest of the family.

on this basis, our research paper dealt with the issue of the legal status of the public prosecution in the Algerian family law, where the study revealed the true status of the public prosecution for its intervention in family affairs issues, which defined a jurisprudential difference between a supporter and an opponent, and the study ended with determining the penalties for the public prosecution’s in cases family affairs and the penalty for not notifying them, while defining the position of the Algerian legislator on this.
