This research paper aims to clarify the necessar pillars for concluding a commercial company contract and the impact of its lack of availability.

in addition to the general pillars required in each contract, the company contract requires the availability of special pillars and it is a formal contract.

the availability of these pillars results in the birth of a new moral person, and in return, the failure of these pillars or the disruption of their conditions results in what is known as invalidity, it has features that are unique to it in this field, whether in terms of its types: absolute, relative and special, or in terms of who can adhere to it and in whose face, this results in what is known as the actual company theory, all this taking into account the differences between people companies and money companies.
