Scientific developments related to communication and information networks have revealed a new program called electronic mediator or electronic agent, a program that is used to conclude contracts electronically between a person and a computer or between two devices without the need for the intervention of any human element to perform this contract, as this new technology appeared, and it is one of the techniques which opened new horizons for the internet and paved the way for the emergence of the second generation of the world wide web, which will allow the exchange of data and information and the conclusion of smart contracts, whether commercial or any other type of contracts in a secure and higher privacy, without the need to refer to commercial intermediaries or intermediary institutions.

therefore, we will show in this study what the concept of electronic mediator is, clarify its legal nature, and mention some of the legislation that adopted it.
