Despite the positive impact of information systems on lives and activities of individuals, they have not been spared from bad and illegal exploitation by exploiting the geographical and spatial dimensions provided by these information systems, the speed of implementation and spread, and the weak legal framework for these illegal behaviors.

regardless of all the efforts made by the competent authorities in most countries, whether individually or within the framework of collective coordination in order to prove various information crimes, and investigate them in order to reach the identification and prosecution of the perpetrator within the framework of achieving the protection of the public interest, as well as preserving the private interests of the victims, all these efforts collide with a number of legal challenges that prevent completion of the desired goals of these investigations.

the importance of researching the subject of this article is based on the need to determine the position of the Algerian legislator in addressing these challenges, which constitute a barrier to reducing and combating cybercrimes.
