Abstract EN

Competition is a legitimate means in the areas of the economy, and its uncontrolled approval would lead to a range of practices that are contrary to it, namely arbitrariness in the dominant position of the market and that are prohibited only when abused.

however, according to article 09 of ordinance 03-03 on competition, we note that the legislature has excluded two cases of arbitrariness resulting from market dominance: agreements and practices resulting from the application of a legislative or regulatory text taken in its application, as well as the exception resulting from the proscribed practice's contribution to economic and technical progress.
