This study aims to shed light on the legal guarantees decided by the Algerian legislator for debtors in the judicial division of the common property in the face of the partners in common, which lies in the right of creditors to interfere in the judicial division procedures for the common property.

one of the most important findings is that creditors may interfere in the judicial division procedures, whether through opposition or they are entered by the partners, where the division is not exhausted in the right of the opposing creditors or their rights are restricted before filing the lawsuit in the event that they are not included in the judicial division procedures the common property.
