The Algerian constitution stipulates the authority of the president of the republic in the legislation by order, this authority has never been exercised in any way, but rather the constitution surrounded it with a set of restrictions and controls as an exceptional authority, which can reading article 142 of the constitution revised in 2016 and 2020, the constitutional basis of the first two amendments imposes new restrictions on the legislative power of the president of the republic, in order to reflect the principle of limiting the legislative of order, as well as the principle of supervision, whether in parliament or the constitution, we find that the power of the president of the republic in the legislative is and limited by time objectively and formally, aiming at this research paper aims to study the effectiveness of these restrictions to limit the legislative of orders, and protect the general competence of the legislature to make laws.
