Abstract EN

The present study aims to clarify the legal controls that ensure determining the method of applying the mechanism of petitioning the unconstitutionality of laws in Algeria in the light of the provisions of organic law 19 / 22.

it focuses on clarifying the formal and objective conditions required in time of presenting the method of petitioning the unconstitutionality mechanism by the parties of the judicial dispute.

the objective of the study was to find out the extent to which the Algerian legislator has reached in providing guarantees for the protection of rights and freedoms through post-exercise control over laws under the method of petitioning unconstitutionality, especially after the transition of the constitutional judiciary from the constitutional council model to the constitutional court model under the constitutional amendment in 2020.
