This intervention revolves around arbitration as a mechanism of reconciliation and conflict resolution between spouses in divorce cases.

is the judge obligated to appoint the two arbitrators as stipulated in article 56 of the family law, or is the matter subject to his discretionary authority, as referred to in article 446 of the civil and administrative procedure code, and how Islamic jurisprudence established this complete system applied in various fields.

the intervention also centers around clarifying the position of Arab legislation on that and how it organized arbitration in the field of divorce cases, all of this in order for us to know the feasibility and effectiveness of article 56 by comparing all these systems and suggesting the alternative by amending and enriching.
