In order to keep abreast of developments in the commercial environment, the Algerian legislator has worked to move towards a specialized commercial judiciary through the issuance of law 22-13, amending and supplementing law 08-09, which includes the code of civil and administrative procedures.

which created specialized commercial courts, in addition to the previously existing commercial departments, in addition to that, the Algerian legislator worked to enhance the role of alternative means in settling the commercial dispute by imposing on the litigants to resort to mediation if the dispute is before the commercial department, and to conciliation if the dispute is in front of specialized commercial courts.

through this study, it becomes clear to us that the settlement of commercial disputes has become the prerogative of two different judicial bodies : the commercial division present in all courts and the specialized commercial court.
