This research studies the basic rules adopted in the development of Algerian family legislation.

it aims to clarify the foundations adopted by the Algerian legislator in family legislation, and defining the ways of extrapolating these foundations and principles through the articles, and clarifying the criteria for dividing it.

it also aims to evaluate the Algerian family law according to Sharia.

with reference to the importance of preserving the religious beliefs, and its role in preserving legislative constants.

among the most important results of the research is that the elements of family legislation it many ; including the adoption of Sharia as a primary source of rulings.

adopting the arrangement of family relations in some rulings.

in addition, study of the basic components of laws and legislation supports the relationship between legislative texts and the religious and customary marbles of society, and help activate it ties.

in addition, if this relationship develops, the provisions of legislation will increase stability, certainty and acceptance.
