تناولت الورقة البحثية تقييما لمسلك المشرع الليبي في نحن المادة الثالثة من القانون (18) لسنة 2016م بشأن تعديل بعض أحكام القانون رقم (6) لسنة 1423م بشأن أحكام القصاص والدية؛ حيث اتبع المشرع أسلوب الجمع بين العقوبة التعزيرية والدية لجريمة القتل الخطأ؛ في إطار محاولته لإحداث التوافق مع أحكام الشريعة الإسلامية، في حين أن جزاء القتل الخطأ واضح وجلي بنص القرآن الكريم المتمثل في: الكفارة والدية في الآية (92) من سورة النساء، ولهذا رأيت اختيار العنوان التالي: (نظرة تأملية في الجمع بين العقوبة التعزيرية والدية لجريمة القتل الخطأ)؛ للتعرف على الحكمة التي حرص المشرع للوصول إليها من خلال الجمع بين العقوبة التعزيرية والدية في الجريمة سالفة الذكر؛ وللإجابة على بعض التساؤلات المهمة، وقد قسم البحث إلى مطلبين يتعلق المطلب الأول بقراءة للعقوبة المقررة لجريمة القتل الخطأ وفق آخر التعديلات، ويتناول المطلب الثاني تقييم مسلك المشرع في الجمع بين العقوبة التعزيرية والدية، وينتهي البحث بخاتمة تتضمن أهم النتائج والتوصيات.
English Abstract
The research paper dealt with an assessment of the behavior of the Libyan legislator in the text of Article 3 of (18) for the year 2016 CE regarding amending some provisions of Law No.
(6) of 1423AD regarding the provisions of qisas and parentage.
Where the legislator used the method of combining the discretionary punishment and blood money for the crime of manslaughter.
In the context of his attempt to bring about compatibility with the provisions of Islamic Sharia, while the penalty for wrongful killing is clear and clear in the text of the Noble Qur’an represented in: expiation and blood money in verse (92) of Surat al-Nisa ', and for this I saw choosing the following title: A contemplative view on combining discretionary punishment and blood money For the crime of manslaughter); To learn about the wisdom that the legislator was keen to reach by combining the discretionary punishment and blood money in the aforementioned crime; In order to answer some important questions, the research has been divided into two demands, the first requirement relates to a reading of the penalty prescribed for the crime of manslaughter, according to the latest amendments, and the second requirement deals with the evaluation of the legislator’s behavior in combining the discretionary punishment and parental punishment, and the research ends with a conclusion that includes the most important findings and recommendations.
