Arabic Abstract

إن التساؤل عن قيمة الأيديولوجية الفكرية، ودورها في بناء مؤسسات الدولة، يجد صداه المؤثر في القواعد الدستورية التي تعكس هوية الدولة، وفي مجتمعاتنا العربية، والإسلامية عموما، تحتل مسألة المرجعية صدارة النقاشات منذ عصر الاستقلال، وقيام الدولة القطرية، وفي ليبيا خصوصا الدولة التي تقف على أعتاب مرحلة دستورية تأسيسية، تجد نفسها على أطراف العلاقة الحدية، بين المرجعية الإسلامية المؤسسة على الموروث الديني، وتلك الغربية القائمة على قيم العلمانية والانفتاح، لذلك عكفت هذه الدراسة على بيان تموقع المسألة المرجعية في الوثائق الدستورية الليبية، وتحليل النصوص الواردة فيها، للمساعدة في الفهم الدقيق لتوجه الدولة، قد يساهم في ترسيخ معالم الدستور المرتقب، كما حللت هذه الدراسة المفاهيم المتشابكة والمتضادة والتي تستند على ثوابت دينية من جهة، وعلى التجربة السياسية الغربية من جهة أخرى، لنخلص إلى ضرورة الموازنة بين الاتجاهين، من أجل صياغة تصور دستوري مستقل، يعكس الخصوصية الوطنية، ولا تكون نصوصه محاكاة حرفية للدساتير الغربية.

English Abstract

The question about the value of intellectual ideology and its role in building state institutions is found its influential echo in the constitutional relues that reflect the identity of the state and in our Arab and Islamic societies.

In general, the question of reference has occupied the forefront of discussions since the era of independence and the establishment of the Qatari state Libya, in particular is the country that is on the threshold of a founding constitutional stage and finds itself on the fringes the boundary relationship between the Islamic authority based on the religious heritage and the western one based on values of secularism and openness therefore, this study sought to clarify the location of the reference issue in the documents the Libya constitution and the analysis of the texts contained therein to help in accurate understanding of the state's orientation, it contributes to consolidating the features of the prospective constitution.

This study also analyzed the interlocking and contradictory concepts, which is based on religious constants on the one hand, and on the western political experience on the other hand, to be saved the necessity of balancing the two trends in order to formulate an independent constitutional vision that reflects privacy patriotism and its text are not a literal simulation of western constitutions.
