أعتمد المشرع المغربي في في شتنبر2016 ظهير شريف رقم 1.16.124 صادرفي 21 من ذي العقدة 1437 الموافق ل 25 غشت 2016 بتنفيذ القانون رقم 66.12 المتعلق بمراقبة و زجر المخالفات في مجال التعمير و البناء، و هدف هذا القانون إلى تمكين المغرب من نص قانوني يتجاوز من خلاله القصور التي يعرفها نظام الرقابة و الزجر المعمول به حاليا، عبر تعزيز الحكامة في هذا المجال، بتجميع مختلف المقتضيات الزجرية المتنائرة بين القوانين العامة و النصوص الثلاث المنظمة لقطاع التعمير بالمغرب : القانون رقم 12.90 المتعلق بالتعمير، الصادر بتنفيذه الظهير الشريف رقم 1.92.31 بتاريخ 15 ذي الحجة 1412 ( 17 يونيو 1992)، القانون 25_90 المتعلق بالتجزئات العقارية والمجموعات السكنية وتقسيم العقارات، الصادر بتنفيذه الظهير الشريف رقم 1927بتاريخ15 ذي الحجة 1412 ( 17 يونيو 1992).، الظهير الشريف رقم الصادرفي 30 من ذي الحجة 1379 (25 يونيو 1960) بشأن توسيع نطاق العمارات القروية كما بهدف هذا القانون إلى وضع حد لهذه الظاهرة التي تؤثر على معظم مدن البلاد و على الرغم من مزاياه، أثار هذا القانون استياء شديدا من جانب العديد من المهندسين المعماريين، و لا سيما أولئك الذين يمارسون مهنة القطاع الخاص.
و سنحاول من خلال هذه المقالة توضيح و عرض أهم المستجدات التي جاء بيا القانون الجديد و كذلك تحليله النقدي الذي يسلط الضوء على الاختلالات التي أثارت ردود فعل واسعة من المهندسين المعماريين الذين اقترحوا عدة تعديلات على نص القانون.
و يبين تحليل الخطاب الذي نقله العديد من المهندسين المعماريين، من خلال حشد مجموعة متنوعة من العمل (المقالات الصحفية.
و المقابلات، و البث الإذاعي، و اجتماعات التنسيق مع الجهات الفاعلة المعنية، و ما إلى ذلك)، أن تعبئهم القوية تفسر بالدور الجديد الذي كلف بم و المخاطر الرئيسية التي يتعرضون لها الآن.
Abstract EN
In September 2006, the Moroccan legislator adopted the law n° 66-12 on the control and the repression of the infringements in the field of urban planning and construction with a view to putting an end to this phenomenon which taints most of the cities of the country.
despite its merits, this law has aroused strong dissatisfaction from many architects, particularly those working in the private sector.
this article tries to elucidate the innovations of this law as well as the anomalies and the characteristics of the mobilization of the architects to oppose it.
the analysis of the discourse conveyed by several architects in the different channels of transmission (interviews, press articles, radio broadcasts) shows that their strong mobilization is explained by the new role they have been assigned and the major risks to which they are now exposed.

Le législateur marocain a adopté la loi n°.66-12 relative au contrôle et à la répression des infractions dans le domaine de l’urbanisme et de la construction en septembre 2016, et ce en vue de mettre fin à ce phénomène qui entache la plupart des villes du pays.
Malgré son bien-fondé, cette loi a suscité un vif mécontentement de la part de plusieurs architectes, particulièrement ceux qui exercent dans le secteur privé.
Cet article tente d'élucider les nouveautés de cette loi ainsi que son Analyse critique qui met en relief les anomalies et dysfonctionnements qui ont suscité une large mobilisation des architectes lesquels ont suggéré plusieurs amendements du texte de loi.
L'analyse du discours véhiculé par plusieurs architectes, en mobilisant un répertoire d'action diversifié (articles de presse, interviews, émission radio, réunions de coordination avec les acteurs concernés, etc.), montre que leur forte mobilisation s’explique par le nouveau rôle qui leur a été attribué et les grands risques auxquels ils sont désormais exposés.
