The original in the contract is to be concluded enforceably and bindingly, thus, neither of the two parties is allowed to dissolve it or change any condition in it, except by mutual consent or litigation, except that the consumer in electronic contracts is not like any contractor and not like any other consumer, as it is clearly considered as the weakest party in the contract, therefore, some legislation gave the consumer in electronic contracts an option that enables him to refer to the contract he concluded during a certain period, especially that he does not see the commodity he is contracting on, and that the protection provided by the provisions related to defects of will may not be feasible in many cases.

So, the aim of this study was to remove confusion from the provisions on which the right to refrain from the electronic consumption contract is based, and to clarify the procedures that the consumer is following to exercise this right And clarify the procedures followed by the consumer to exercise this right, which was authorized by the law, and clarify its effects, in both of the Algerian and Moroccan legislations.
