08-11 regulating the entry, residence and movement of foreigners into the Algerian territory granted the Minister of the Interior for the purpose of immunizing its territory from illegal immigration, the power to deport foreigners who are in an illegal situation in Algeria, or whose presence there poses a threat to its security from the Algerian territory.

, by virtue of the sovereignty of states over their territory and their right to expel anyone who threatens their security, but he framed this procedure with a number of reasons and procedures that the administration must respect, otherwise its decision is considered illegitimate.

However, the same law grants the foreigner addressed by the deportation decision some rights in order to achieve a balance between the right of the state over its territory and the basic human rights of the illegal immigrant.

La loi n° 08-11, réglementant l'entrée, le séjour et la circulation des étrangers sur le territoire algérien, a accordé au ministre de l'intérieur, aux fins d'immunisation de son territoire contre l'immigration clandestine, le pouvoir d'éloigner les étrangers en situation irrégulière ; situation en Algérie, ou dont la présence constitue une menace pour sa sécurité depuis le territoire algérien.

Cependant, dans le but de concilier le droit de l'État avec les droits fondamentaux des immigrés malgré l'illégalité de leur présence en Algérie, la même loi a accordé à l'étranger visé par la décision d'expulsion le droit de la contester en référé devant le tribunal administratif pour annulation, avec possibilité de surseoir à son exécution jusqu'à au prononcé de la décision au fond et l’étranger concerné est placé, pendant cette période dans des centres d'hébergement, entouré de toutes les garanties du justiciable.
