عقد العمل الرياضي يعتبر عقد عمل يخضع لآليات قانون العمل، بحيث أنه يخضع لأحكام هذه القوانين وذلك نظرا لتوافره على عنصر الأجر الذي يتقاضاه الرياضي الأجير نظير ممارسته لهذا النشاط، وأيضا توافر هذا العقد على عنصر العمل والمتمثل في العمل الرياضي الذي يقوم به لصالح النادي تحت سلطته وإشرافه واعتباره مصدر رزقه الأساسي.
وتوافر هذا العقد أيضا على أهم عنصر في هذا العقد وهو عنصر التبعية والذي يتجسد من خلال سلطة الإشراف والتوجيه وتوقيع العقوبات من طرف النادي باعتباره هيئة مستخدمة.
على الرغم من وجود بعض الإشكالات التي تعتري هذا العنصر، إلى أنها لا تؤثر على قيامه بل تعززه، حيث أن وجودها تفرضه فقط طبيعة النشاط الرياضي وخصوصياته.
وعليه فإن عقد العمل الرياضي يمكن تعريفه على أنه عقد عمل محدد المدة يلتزم فيه الرياضي بممارسة نشاط رياضي معين لصالح النادي المتعاقد معه بكل ما يستلزمه ذلك من واجبات خاصة، مقابل حصوله على أجر من هذا النادي.

The employment contract of sports is a work contract subject to the mechanisms of the labor law, which is subject to the provisions of these laws, because it is available on the wage component paid by the sportsman for the exercise of this activity, as well as the availability of this contract on the work component represented in the sports work done for the club under His authority and supervision as his source of livelihood is essential, This contract is also available on the most important element of this contract, which is the element of subordination, which is embodied through the authority of supervision, direction and sanction by the club as an entity.
Although there are some problems in this element, it does not affect the establishment, but strengthens it as its existence is imposed by only the nature of sports activity and its specificities.
Therefore, the contract of sports work can be defined as a fixed-term employment contract in which the athlete is obliged to exercise a certain sport activity for the club contracted with all the required special duties, in return for receiving a salary from this club.

Le contrat de travail des sports est un contrat de travail soumis aux mécanismes du droit du travail, qui est soumis aux dispositions de ces lois, car il est disponible sur la composante salariale versée par le sportif pour l'exercice de cette activité, ainsi que la disponibilité de ce contrat sur le volet travail représenté dans le travail sportif effectué pour le club sous son autorité et sa supervision comme source de subsistance est essentielle , Ce contrat est également disponible sur l'élément le plus important de ce contrat, qui est l'élément de subordination, qui s'incarne à travers l'autorité de supervision, de direction et de sanction par le club en tant qu'entité.
Bien qu'il y ait quelques problèmes dans cet élément, il n'affecte pas l'établissement, mais le renforce car son existence n'est imposée que par la nature de l'activité sportive et ses spécificités.
Par conséquent, le contrat de travail sportif peut être défini comme un contrat de travail à durée déterminée dans lequel l'athlète est obligé d'exercer une certaine activité sportive pour le club sous contrat avec toutes les tâches spéciales requises, en échange d'un salaire de ce club
