Abstract EN

Researchers do not disagree on the importance of freedom of communication in modern societies, because it is a fundamental freedom and one of the basic foundations of a democratic society and one of the original conditions for its development and the prosperity of individuals, as the cornerstone of human rights principles, and a key guarantee for the exercise of other fundamental constitutional rights and freedoms, and one of the precious cores values of a democratic state, translate and embodies in practice the freedom of expression constitutionally, enshrined in Algeria after the democratic transition under the constitution of 23 February 1989.

this study attempts to examine the necessity of constitutional and legal recognition of this freedom and its regulation in Algerian legislation, the constitutional and legal guarantees to achieve its effective exercise and the limits of the exercise of this fundamental human right, in order to preserve public order and public security , and the legitimate rights of other in society.
